FOOD RELATED SUPPLEMENTAL CALIFORNIA CONSUMER PRIVACY ACT (CCPA) POLICY

This Privacy Policy for California Residents supplements the information contained in our Privacy Policy and applies to individuals who reside in the State of California. Food Related provides this notice to comply with the California Consumer Privacy Act of 2018 ("CCPA") as amended by the California Privacy Rights Act of 2020 ("CPRA"). To the extent this policy conflicts with our Privacy Policy, this policy governs for California residents.

About this Policy

Food Related = RJL Texas-International, LLC, a Texas limited liability company, its U.S. affiliates and subsidiaries and service providers (collectively, "Food Related", "we", "our" and "us").

You/Your = customers, consumers, employees, applicants, contractors, and visitors (including their agents and representatives) of the entity or party you are acting on behalf of.

Personal Information = information that identifies, relates to, or could reasonably be linked with a particular California resident or household. However, personal information does not include publicly available, deidentified, or aggregate consumer information (which are all defined in CCPA/CPRA).

Sell/sold = the disclosure of Personal Information for monetary or other valuable consideration.

Sharing = the targeting of advertising to a consumer based on that consumer's personal information obtained from the consumer's activity across websites, and "selling" is defined as the disclosure of personal information to third parties in exchange for monetary or other valuable consideration. "Personal Information" is information that identifies, relates to, or could reasonably be linked with a particular California resident or household.

The specific Personal Information that we collect, use, and disclose relating to a California resident covered by the CCPA will vary based on our relationship or interaction with that individual.

Under the laws of California and certain other US states (i.e., Virginia), we are required to provide you with the following additional information about: (1) the purpose for which we use each category of "personal information" we collect; and (2) the categories of third parties to which we (a) disclose such personal information for a business purpose, (b) "share" personal information for "cross-context behavioral advertising," and/or (c) "sell" such personal information.

Data Collection and Use

Food Related collects certain categories of data including personal information about you for purposes such as offering products and services, servicing your account, and providing employment services.

Data Collection and Use

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("personal information").  In particular, we may have collected the following categories of personal information from consumers within the last twelve (12) months:

  • Identifiers (e.g., name, mailing address, email address, phone number, credit/debit card number)
  • Characteristics of protected classifications (e.g., age, sex, race)
  • Commercial information (e.g., products or services purchased, purchase history)
  • Internet or other electronic network activity (e.g., browse or search history)
  • Geolocation data (e.g., latitude or longitude)
  • Audio, electronic, visual, or similar information (e.g., recording of Guest service calls)
  • Inferences drawn from any of the above (e.g., preferences or characteristics)

Business or Commercial Purposes for Which Food Related Collects, Shares (for Cross-Context Behavioral Advertising), or Sells Personal Information about Customers (also see the how is your information used section of this Privacy Policy). We collect and disclose this information:

  • To help us identify and authenticate you, for fraud prevention and similar purposes.
  • To perform services including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytics services, providing storage or providing similar services.
  • For legal compliance.
  • To provide advertising and marketing services.
  • For auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance;
  • For short-term, transient use, such as non-personalized advertising shown as part of your current interaction with us;
  • To personalize your experiences.
  • As necessary or appropriate to protect our rights, property or safety of us, or those of our clients or others.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • For communicating with you.
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets.
  • To ensure security and integrity.
  • For debugging to identify and repair errors that impair existing intended functionality.
  • For undertaking internal research for technological development and demonstration.
  • Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us.

CCPA provides California residents with the right to opt-out of the sale or sharing of their personal information. 

Food Related does not offer an opt-out from the sale or sharing of personal information because we do not engage in the sale or sharing of personal information as contemplated by the CCPA. Additionally, we do not knowingly sell or share information regarding children under the age of 16. 

How Long We Retain Your Information

Food Related retains Personal Information consistent with our record retention policies and as required by law. This enables us to comply with legal and regulatory requirements or use it where we need to for our legitimate purposes such as managing your account and dealing with any disputes or concerns that may arise. We may need to retain your information for a longer period where we need the information to comply with regulatory or legal requirements, or where we have another lawful reason to do so, e.g. fighting fraud and financial crime, responding to requests from regulators, etc. If we do not need to retain information for this period of time, we may destroy, delete or anonymize it consistent with our records retention policies.

Our Sources of Information

We obtain information from the following categories of sources:

  • Directly from individuals or their agents. For example, from documents that you provide to us in order to apply for, obtain, or maintain our Services.
  • Indirectly from individuals or their agents. For example, through information we collect in the course of providing Services to you, such as information collected during customer care interactions.
  • From vendors and third party service providers that provide services on our behalf. For example, information required for marketing, account opening, and servicing.
  • From advertising networks, data analytics providers, government entities, social networks, operating systems and platforms, and data brokers.
  • Directly and indirectly from activity on our websites or partner websites or via mobile applications. For example, from submissions through our website portal or website usage details collected automatically.

Recipients of Disclosures for Business Purposes

We disclose personal information for the business purposes described in above. When we disclose personal information for a business purpose, we enter a contract that describes the purposes and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

We disclose your personal information for a business purpose to the following categories of third parties:

  • Our affiliates.
  • Service providers that act on our behalf, such as data storage providers, email providers, and advisors.
  • Third parties to whom you or your agents authorize us to disclose your personal information in connection with products or services we provide to you.

Your Rights under CCPA

The CCPA provides California residents with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Among other rights provided by CCPA, you have the right to request access to the personal information we collect about you, the right to request that we correct the personal information we collect, the right to request that we delete the personal information we have collected from you, right to request Food Related opt you out of the sale of your personal information or sharing of your personal information for cross-context behavioral advertising. and the right not to receive discriminatory treatment for the exercise of your CCPA privacy rights.

  • Your contact information
  • What is your authorization to make this request?
    • Registered with the California Secretary of State
    • Power of Attorney; or
    • Parent/Legal Guardian of a Minorr

Please note that your request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot provide you with personal information if we cannot verify your identity or authority to make the request or we cannot confirm the personal information relates to you. Making a request does not require you to create an account with us. We will only use personal information provided in your request to verify your identity or authority to make the request.

IMPORTANT: These rights are not absolutely guaranteed and there are several exceptions where we may not have an obligation to fulfill your request. We are only required to honor these rights to the extent we act as a controller of that data and the requested rights have been granted and apply to you under applicable data privacy laws. Please consult your local data privacy laws to determine what rights may be available to you and when access to these rights is limited. You may appeal an adverse decision on your requests by emailing or writing to us; and you have the right to lodge a complaint to your local regulator if you are not satisfied with our responses to your requests or how we manage your personal information. However, we encourage you to first contact us so we can address your concerns directly.

We process sensitive personal information only for those purposes expressly permitted under California law.

To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.

Changes to Our CCPA Policy 

We reserve the right to amend this privacy policy at our discretion and at any time. When we make changes to this privacy policy, we will notify you by email or through a notice on this page.
